CASL compliance checker for realtors

Canada's Anti-Spam Legislation (CASL) governs every commercial email and text a realtor sends. Answer the questions below about the one message you want to send to one person, and get a plain-language read on whether it's likely on-side. This tool is educational information, not legal advice.

1. What consent do you have from this person?
3. Does the message include a working unsubscribe mechanism?
4. Does the message clearly identify you as the sender?

Answer the questions for a read

Work through all the questions above and a plain-language verdict appears here.

Educational information about the general CASL rules — not legal advice, and not a legal determination about any specific message. Edge cases (referrals, B2B carve-outs, transactional messages, conspicuous publication) turn on facts a checklist can't see; when in doubt, ask a lawyer.

What CASL actually requires

Consent first. Before you send a commercial electronic message you need express consent (they clearly said yes, and it lasts until withdrawn) or implied consent (an existing business relationship, or a recent inquiry). No consent, no send — however good the lead source looked.

Implied consent runs on a timer. An existing business relationship — a purchase, sale, lease, or written contract — generally gives you two years from that transaction. An inquiry about your services generally gives you six months. Express consent is the only kind that doesn't lapse on its own.

Every message needs sender ID and an unsubscribe. Your name, your brokerage, a mailing address, a way to reach you, and a working unsubscribe mechanism honoured within 10 business days — on every single commercial message, no matter how good the consent is.

Keep records. The burden of proving consent sits with the sender. Log when and how each consent was obtained and what exactly the person agreed to — a CRM that stamps consent on every contact does this for you automatically.
